Texas Divorce Statistics
In case No. 02-0025, Daniel Waite, Sr. v. Margaret Susan Waite,
the Supreme Court of Texas stated:
"Whereas, contested use of Texas No-fault Insupportability cannot be justified in its
statutory scheme. The divorce is virtually always granted on one party's demand. The no-fault
statute's "Reasonable expectation of reconciliation" language can never realistically be defeated
on a contested divorce. Spouses at a contested divorce trial may possibly reconcile—but it is
virtually never found—by that time. By the time of trial, the more defense, the more
determination to fight it. For that reason, many courts and lawyers say there is "no defense" to no-fault
divorce. Statistics prove it is so. The "denied" ratio of Texas divorce statistics dropped roughly ten-fold to less than 20
cases
denied out of 100,000 granted during the late 1970's—perhaps 20 flukes or other technical problems."
