The Board of Legal Specialization offers attorneys the opportunity to qualify as a Family Law specialist. To
qualify, each attorney must accumulate trial experience relating to divorce in Texas and pass a written

Divorce in Texas - Child Custody Attorney's Duties
Custody is not an all or nothing proposition. All child custody attorneys representing a client in a divorce
in Texas have a sworn duty to fully advise clients of parental options. As a starting point, parental custody
options include:
- Sole Custody - one parent receives the exclusive right to make important decisions regarding the child and
becomes the sole legal guardian. Following a divorce in Texas, the remaining parent may have visitation
rights.
- Joint Custody - Neither parent receives an exclusive right to make important decisions and must cooperate
sharing rights and responsibilities equally. Children alternate living with both parents after a divorce in
Texas.
Modifications of divorce in Texas:
All Texas custody laws and orders survive a divorce in Texas. After a determination of child custody, Texas
allows modification of visitation based upon the needs of children. Also, child custody laws in Texas permit
modification of support payments due to changes in income. In the event neither parent is deemed fit, Texas child custody laws
substitute courts as a parent of last resort. |
